服装品牌Penguin起诉NFT品牌Pudgy Penguins侵犯其商标权
PANews 3月6日消息，据The Block报道，企鹅（Penguin）服装品牌所有者PEI Licensing向联邦法院提起诉讼，指控NFT品牌Pudgy Penguins侵犯其商标权。PEI称，其于2023年10月向Pudgy Penguins发出停止侵权函，但后者仍继续生产和销售毛绒玩具及服装等零售商品，导致PEI创立于1955年的Penguin品牌价值被稀释。诉状中列举了Pudgy Penguins涉嫌侵权的实例，称其未经授权使用商标会使消费者误以为两者存在关联。
Pudgy Penguins尚未回应置评请求。该品牌自2023年起开始在沃尔玛、塔吉特等连锁店销售毛绒玩具，次年宣布销量突破100万件，并推出帽子、卫衣等服装产品。PEI正寻求获得被告销售利润及损害赔偿，并要求陪审团审理。
